Etapa — AI-Powered Cycling Coach

1. Acceptance of Terms

By downloading, installing, or using the Etapa mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Etapa reserves the right to update these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after such notification constitutes acceptance of the updated Terms.

2. Description of Service

Etapa is a cycling training application that uses artificial intelligence to generate personalised training plans, provide coaching advice, and help you prepare for cycling events. The App includes:

• AI-generated training plans tailored to your goals, fitness level, and schedule
• Interactive AI coaching chat with selectable coach personas
• Plan editing, activity management, and calendar views
• Progress tracking and training load management

3. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian.

4. Account Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

5. AI-Generated Content Disclaimer

Etapa uses artificial intelligence (powered by third-party AI services) to generate training plans, coaching advice, and other content. You acknowledge and agree that:

• AI-generated content is provided for informational and guidance purposes only and does not constitute professional medical, fitness, or health advice.
• Training plans and coaching suggestions are generated algorithmically and may not account for all individual health conditions, injuries, or physical limitations.
• You should consult a qualified healthcare professional before beginning any new exercise programme, particularly if you have pre-existing health conditions.
• Etapa is not liable for any injury, health issue, or adverse outcome resulting from following AI-generated training plans or coaching advice.
• AI coach personas are fictional characters and do not represent real individuals or certified coaches.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble any part of the App
• Interfere with or disrupt the App's servers, networks, or infrastructure
• Use automated tools, bots, or scrapers to access the App
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Share your account credentials with third parties or allow others to access your account

7. Intellectual Property

The App, including its design, code, AI models, coach personas, branding, and all associated intellectual property, is owned by Etapa and its licensors. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited licence to use it as described herein.

You retain ownership of any personal data you provide (such as goals and training preferences). By using the App, you grant Etapa a limited licence to process this data solely for the purpose of providing the service.

8. Subscriptions and Payments

Certain features of the App may require a paid subscription. Subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store. You may cancel your subscription at any time through your device's app store settings.

All purchases include a 7-day full refund guarantee. To request a refund, use the "Request Refund" option in the app's Settings, or visit reportaproblem.apple.com (Apple) or your Google Play subscriptions (Android) within 7 days of purchase. Refunds are processed by the Apple App Store or Google Play Store, as applicable. Etapa does not process payments directly.

9. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App and delete your account at any time. Upon termination, your right to use the App ceases immediately.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ETAPA DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ETAPA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL ETAPA'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO ETAPA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED POUNDS STERLING (£100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Etapa and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
